WAIVER: TRIFUSION, LLC, PARTICIPANT AND ARBITRATION AGREEMENT, INDEMNIFICATION, GENERAL RELEASE AND ASSUMPTION

By signing this agreement, you are giving up your and/or your spouse and minors’ legal rights, including the right to bring a lawsuit in court and/or have the claim decided by a jury.
IMPORTANT NOTICE
By signing this agreement, you acknowledge that you are waiving the right to sue TRIFUSION, LLC for any injury, including paralysis or death, caused by the negligence or fault of TRIFUSION, LLC, including its agents, employees, and equipment.
AGREEMENT TERMS:
- PARTICIPATION AND RELEASE OF LIABILITY
In consideration of being allowed to participate in any or all of the services and activities provided by TRIFUSION, LLC, I hereby agree to forever release, indemnify, and discharge TRIFUSION, its agents, employees, contractors, and all other related entities from any and all liability for injury or damages that may arise during the activities, including but not limited to physical or emotional injury, or death. - ACKNOWLEDGEMENT OF RISKS
I acknowledge that participation in the activities may involve inherent risks, including injury, permanent disability, or death, stemming from factors such as equipment malfunctions, slips, falls, and negligence. Despite these risks, I voluntarily assume all liability associated with these activities. - HEALTH AND FITNESS
I affirm that I, along with my spouse and minor child(ren) (if applicable), am in good health and physically capable of participating in the activities offered by TRIFUSION, LLC. I will not engage in any activity that causes strain or pain, and I am not under the influence of alcohol or drugs. - SAFETY DURING ACTIVITIES
I agree to familiarize myself with and follow all safety rules provided by TRIFUSION, and to stop participating in any activity if I feel discomfort or strain, or if I need to rest. - PREGNANT PARTICIPANTS
Pregnant participants or those who believe they may be pregnant should not participate in certain activities (such as hot yoga) due to potential risks to the mother or child. - INDEMNIFICATION
I agree to indemnify and hold harmless TRIFUSION, LLC, its agents, employees, and all other related parties from any loss, damages, or injuries sustained by me or my family during participation in the activities. This includes, but is not limited to, any negligence on the part of TRIFUSION. - PROPERTY DAMAGE
TRIFUSION, LLC is not responsible for any lost, stolen, or damaged personal property, including but not limited to vehicles, personal items, or items stored in lockers. - PHOTO RELEASE
By signing this agreement, I grant TRIFUSION the irrevocable right to use photos and videos of me and/or my minor child(ren) for promotional or advertising purposes, without compensation or further approval. - MEDIATION AND ARBITRATION
If any disputes arise, I agree to first attempt resolution through mediation administered by the American Arbitration Association (AAA). If mediation does not resolve the dispute, the matter will be submitted to non-binding arbitration in Jefferson County, Alabama, in accordance with AAA’s rules. - GOVERNING LAW AND VENUE
The laws of the State of Alabama will govern this agreement. Any lawsuits or disputes that cannot be resolved through arbitration will be brought in Jefferson County, Alabama.
CONCLUSION
By signing this document, I understand that I am waiving my rights to sue TRIFUSION, LLC, and that I am fully aware of the risks involved in participating in these activities. I acknowledge that I have had the opportunity to review this document and seek legal counsel if desired. By signing, I voluntarily agree to all terms and conditions.
SIGNATURE
By signing below, I confirm that I am at least 18 years old and legally capable of entering into this agreement. If signing on behalf of a minor, I affirm that I am the parent or legal guardian of the child(ren) listed.
This document must be signed by an adult participant, or by a parent or legal guardian for minors.
